Spain entrepreneur residence documents: what we review

Every application starts from different circumstances. Your country of residence, professional background, business and family plans shape the review. The Spain entrepreneur visa requirements provide a starting point that needs to be tailored to your case.

The legal framework includes Articles 62, 69 and 70 of Spanish Law 14/2013 of 27 September. The evidence must fit both the procedure and the circumstances of each applicant.

Entrepreneur residence documents: passports and criminal records

First, we review your identity and immigration position. We check that personal details match across documents and that the dates support your proposed application. We also consider the evidence of your previous countries of residence.

For criminal records, the law distinguishes between countries of residence during the last two years and a personal declaration covering the last five. These are separate requirements. We therefore review your residence history before identifying the certificates you need.

Apostilles, legalisation and translations

A document accepted in your home country may need additional formalities for use in Spain. Depending on the document and issuing country, we check whether an apostille, legalisation or an exemption applies. We also review the translation requirements of the receiving authority.

An apostille authenticates the relevant formal features; it does not correct errors or replace a translation. For example, different surnames across certificates may require further evidence. An early review can prevent unnecessary translation costs.

We also coordinate the issue dates of certificates. Their acceptable age must be checked for the specific procedure. This allows us to explain which documents should be requested first and which should be obtained closer to submission.

Business documents for entrepreneur residence in Spain

The UGE’s official entrepreneur guidance explains the assessment of your background, business plan and economic contribution. ENISA reports on the entrepreneurial activity. The competent immigration authority decides the residence application.

We therefore connect your experience with the role you will perform. We then review the proposed investment, funding sources and business assumptions. Where several partners are involved, we examine each person’s participation and contribution.

Depending on the stage of the project, useful evidence may include quotations, agreements, development records or commercial documents. We select evidence for what it actually establishes. Forecasts must remain distinct from completed sales, and funding commitments from money already available.

Residence documents for your finances and family

Money for living in Spain and finance for the business serve different purposes. We review the availability of funds alongside the needs of the project. In particular, we check that the same funds are not assigned to incompatible uses.

We also assess healthcare cover and each family member’s documents. Marriage, partnership, parentage and dependency require evidence suited to the relevant application. A family certificate alone may be insufficient where financial dependency must also be established.

Planning the family applications early helps coordinate certificates, translations and travel dates. As a result, you can assess your relocation with a clearer understanding of the whole application.

Entrepreneur residence documents: applying from abroad or Spain

Your location affects preparation. If you are legally in Spain, we review your current status and the timing of the UGE application. If you live abroad, we coordinate the residence authorisation with the relevant Spanish consular visa process.

Under the current framework, an applicant outside Spain applies for the relevant residence visa after the residence authorisation has been granted. This should not be confused with the former preparatory visa under Article 68, which was removed.

We also check the current forms and fees when preparing each stage. Consular charges can vary by location and applicant. We clarify these points alongside any steps that require you to attend in person.

Beckham Law: timing matters for your tax position

Your move may create valuable tax planning opportunities. The Beckham Law provides a special tax regime for eligible individuals. However, obtaining a residence permit does not automatically give you access to it.

For the entrepreneurial activity route, Article 113.2 of the Spanish Personal Income Tax Regulations, approved by Royal Decree 439/2007 of 30 March, requires the Article 69 authorisation before relocation to Spain. A specific route applies to individuals with EU free movement rights.

Previous tax residence, the reason for your move and the election deadline also need review. The Spanish Tax Agency explains the evidence required for Form 149. This assessment should take place before you settle on your relocation date.

What if I already have a plan or some certificates?

We can review what you have. The first step is to see what fits your case and what needs more work. There is no need to start again without checking it first. A sound document can save time if it is still valid and suits the application.
