Digital Nomad / International Teleworker

Do you want to telework as a Digital Nomad in Malaga or Nerja? If so, at Pérez Parras Economists and Lawyers we can help you obtain your Visa or Residence Authorisation in Spain as a Digital Nomad or International Teleworker, and enjoy a city like Malaga, with an unbeatable climate, open to the sea and converted into a technological city of reference, with the presence of the main multinationals in the technology sector, a first class University, and a magnificent environment in which to live and telework.

There have been different factors that have made teleworking an organisational priority for companies, as a way of attracting and retaining talent, with Digital Nomads being a clear trend in Spain following the approval of the Spanish StartUps Law. This context motivates companies to sign individual telework agreements with their employees, especially in the technology sector where location is not a determining factor to contribute your talent.

Who can apply for a Digital Nomad Visa or Residence Permit?

International teleworkers or Digital Nomads are:

  • third-country nationals authorised to stay in Spain to work remotely,
  • teleworkers for companies based outside the Spanish national territory,
  • teleworkers working remotely through the exclusive use of computer, telematic and telecommunication means and systems,
  • teleworkers who can prove that they are graduates or postgraduates, or graduates of business schools of recognised prestige, or with higher professional training studies, or with a minimum professional experience of 3 years.

Can I be a Digital Nomad in Spain and work as a freelancer or as an employee?

The answer is yes.

A digital nomad in Spain can work as an employee if youare employed, in which case you can only work for companies based outside Spain.

On the other hand, if the digital nomad carries out a professional activity (as a self-employed person), you can also work for companies based in Spain up to a maximum of 20% of your activity.

Can I apply for my residence and work permit as a Digital Nomad in Spain or abroad?

Yes, you can apply for your visa for international teleworking from outside Spain, which will be valid for a maximum of 1 year, and before the visa expires you must obtain your residence permit for international telework, for a duration of 3 years.

Can family members of the international teleworker also obtain an authorisation/visa to reside in Spain?

Yes, the spouse or person with an analogous relationship of affectivity, minor children who are economically dependent on the teleworker and dependent ascendants can apply jointly and simultaneously, or successively, for the digital nomad authorisation or visa.
