Self-sufficient foreign minors who reach the age of majority and prove their economic means of support will be able to renew their temporary residency.

So far, a foreigner applying for a residency permit in Spain must have enough financial means of support. They must demonstrate they are self-sufficient. This is the criterion that we, the Pérez Parras Economists & Lawyers Firm, have applied for all our foreign clients claiming residency in Spain. This is in accordance with the Law, considering exceptions and casuistry that applies to issues for each particular situation.

Residency and The Supreme Court:

Recently, the Supreme Court¹ has ruled that foreign minors:

-protected by the Government,

-with temporary residency authorisation and

-who reach the age of majority,

must absolutely certify they are self-sufficient. In order to renew the authorisation, the amount must be at least equal to 100% of the Public Income Indicator of Multiple Effects (IPREM²).

The IPREM

The IPREM is an index used in Spain as a reference for the dispensation of grants, allowances or unemployment subsidy, replacing the known Minimum Inter-professional Salary (SMI), since 2004. Since that date, the IPREM has grown at a lower rate than the SMI. Therefore, this has facilitated access to aid for more disadvantaged families. Meanwhile, the SMI has been restricted to the workplace.

Self-sufficient requirements:

The requirement for economic self-sufficiency, established in art. 197.2.a of the Immigration Regulations, is a necessary proviso to obtain the renewal of the temporary residency authorisation that the unaccompanied minor already had. Otherwise, the renewal request can be denied without assessing any other issue.

Actually, the Immigration Regulations have already considered the condition of minors and their passage to the age of majority. So they lowered the requirement of economic income limits from the established 400% support to 100% of the IPREM only. It is a limit that Spanish regulations require unconditionally. They follow the current European regulations that control immigration policy.

Without proof of sufficient economic income equal to or higher than 100% of the IPREM, the Supreme Court absolutely denies the renewal of temporary residency to the protected foreign minor who had a temporary residency permit in Spain and has now reached the age of majority.
