Spain introduces the Golden Visa Spain as a way to facilitate entry and residence in Spain for reasons of economic interest. Thus, in Law 14/2013, of September 27, to support entrepreneurs and their internationalization, it is stipulated that foreigners who intend to enter or reside, or who already reside in Spain, will be facilitated their entry and stay in the Spanish territory for reasons of economic interest, provided that they prove any of the following assumptions:

  • Investors
  • Entrepreneurs
  • Highly qualified professionals
  • Researchers
  • Workers who carry out movements within the same company or group of companies.

All this, taking into account that the Golden Visa Spain and the previous assumptions do not apply to citizens of the European Union or to foreigners to whom the law of the European Union applies because they are beneficiaries of the rights of free movement and residence.

In the case of the Golden Visa Spain, it falls within the cases of residence visas provided for in Regulation (EU) 265/2010, which modifies the Convention implementing the Schengen Agreement and Regulation (EC) 562/2006 , of March 15, with regard to the movement of people with long-term visas, as well as for residence authorizations, the applicant must prove compliance with the following general requirements:

a) Not stay irregularly in Spanish territory.

b) Be over 18 years of age.

c) Lack of criminal records in Spain and in the countries where they have resided during the last five years, for crimes provided for in the Spanish legal system.

d) Not appear as objectionable in the territorial space of countries with which Spain has signed an agreement in this regard.

e) Have public insurance or private health insurance arranged with an insurance company authorized to operate in Spain.

f) Have sufficient financial resources for themselves and for their family members during their period of residence in Spain.

g) Pay the fee for processing the authorization or visa.

 

To facilitate the residence in Spain of the rest of the family of the investor who obtains the Golden Visa Spain, that is, the spouse or person with an analogous emotional relationship, the under age or of legal age children who, depending economically on the holder, have not constituted themselves a family unit and the ascendants in charge, who meet together or accompany foreign investors, may request, jointly and simultaneously or successively, the authorization and, where appropriate, the Golden Visa Spain residence permit. For this, compliance with the previous general requirements listed must be accredited.
