What is the traffic legislation for electric scooters?

The use of electric scooters as a means of transport is now very common in Malaga. Their considerable increase and their lack of regulations have forced the General Directorate of Traffic (DGT) to publish instructions.

They will serve as the basis for future regulations for electric scooters, following the rules that are collected and assimilated to the aspects discussed in the European Union.

Presently, therefore, the regulations for electric scooters are still in the processing phase. However, this does not prevent the DGT from issuing a directive that regulates the basic rules of circulation of scooters.

What has the DGT put in place regarding the use of electric scooters?

The DGT considers electric scooters as personal mobility vehicles.

According to the directive, an electric scooter is “a vehicle with one or more wheels equipped with a single seat and propelled exclusively by electric motors, which can provide the vehicle with a maximum speed by design, between 6 and 25 km / h “.

The following vehicles are excluded from the previous definition:

-Vehicles without self-balancing system and with saddle.

-Vehicles designed for competition.

-Motorised vehicles for people with reduced mobility.

– Scooters with seat, motor cycles, two-wheel mopeds … (these vehicles require administrative authorisation to drive, circulate and have an insurance policy, in addition to the use of the helmet).

In addition, the guidance regarding electric scooters stipulates that vehicles not exceeding 6 km / h are considered toys.

What are the requirements for electric scooters?

The directive does not impose administrative authorisation for electric scooters to circulate or to be driven, nor does it impose a mandatory insurance.

Nor will points be deducted from the driver who circulates with an electric scooter that meets the characteristics that define it.

The DGT instruction refers to the General Traffic Regulations. It concludes that the circulation of all kinds of vehicles on pavements and other pedestrian areas is prohibited. Skates, skateboards or similar devices that are used exclusively at the person’s pace are not included in this prohibition.

What are the offences?

-The drivers of personal mobility vehicles or similar will be required to undergo tests for alcohol and drug rates. In consequence, the penalty could range between 500 and 1,000 euros.

Mobile phone. Driving electric scooters while using the mobile phone is prohibited. Such breach could result in a penalty of 200 euros.

-It is forbidden for two people to ride on an electric scooter. Such breach would result in a penalty of 100 euros.

-The use of headphones may also be subject to a  complaint with a penalty of 200 euros.

-With regard to the use of helmets and other protection items, in the absence of general regulations, the corresponding Municipal Ordinance must be implemented.

-Night circulation without lighting or high vision clothing or reflective elements, is also subject to indictment. It has a penalty of 200 euros.
