Beckham Law: can I leave my job to run my own company?
Planning a Beckham Law job change? Leaving your job to run a company in Spain raises an important question: can you keep the special tax regime? If your spouse is also covered, what happens to their position?
The answer requires a review before you make the change. Leaving your job does not necessarily mean losing the Beckham Law, but it does not guarantee that your new project will qualify either. Your actual activities, director role, company, dates and the conditions of the regime all matter.
At Pérez Parras Economists & Lawyers, we consider your personal position, your family’s situation and your company structure together. That gives you a tailored tax assessment to support your decision.

Beckham Law job change: becoming a company director
The Beckham Law is not a general permission to undertake any activity after moving to Spain. Someone already in the regime may change their professional relationship, but the conditions for applying it must continue to be met. Moving from employee to company director therefore calls for a review of the specific facts.
Article 93 of the Spanish Personal Income Tax Law includes becoming a company director among the situations it addresses. The nature of the company and the director’s shareholding can matter. A director role must also be distinguished from any separate services or business activities performed personally.
The practical question is not simply whether you can form a Spanish limited company, or SL. It is whether your planned transition allows the regime to continue and how it affects your obligations. Our Beckham Law guide sets out the wider context for our advisory service.
A tax ruling on leaving employment to run a company
Binding ruling V0442-26 of 27 February 2026 (see the official DGT search page; if unavailable, see Primera Lectura Ediciones’ analysis, in Spanish) considers a useful example. The principal taxpayer voluntarily left the job that had prompted the move to Spain and became a director of a Spanish company formed with their spouse. The spouse applied the regime as an associated family member.
According to the ruling’s described reasoning, that change does not by itself trigger automatic exclusion, provided the legal conditions continue to be satisfied. The associated spouse’s position also depends on the principal taxpayer remaining eligible and the family member meeting their own requirements.
The answer addresses particular facts. It is not approval for every change of employment, business project or company structure. In particular, the dates and the reality of the new activity need to be considered in each case.
Beckham Law job change: your company and actual role
A company’s name or stated corporate purpose is not enough to settle its tax position. A review of the regime may require an assessment of its assets, actual business, resources, the director’s stake and the functions performed.
If the company is an asset-holding entity for Spanish tax purposes, the law imposes a restriction linked to the director’s shareholding. Conversely, a substantial stake alone does not resolve all the requirements where the company is not an asset-holding entity. Other personal activities and the rules for business income must also be considered.
Our article on the Beckham Law and holding companies explains why the company’s real nature matters. Each business requires its own assessment.

Beckham Law job change: your spouse’s position
If your spouse is covered as an associated taxpayer, their position should be reviewed at the same time. A family member’s continued application is connected to that of the principal taxpayer and also depends on their own conditions.
Article 118 of the Spanish Personal Income Tax Regulations distinguishes joint and individual exclusion. A career decision may therefore call for a family-wide review. The principal taxpayer’s exclusion or renunciation has consequences for associated family members; other breaches may affect only the person concerned.
We can also review the returns and communications applicable to each family member. Our article on the Beckham Law for spouses and children covers a separate compliance question: Form 151 where a family member has no income.
When should you seek advice?
For Beckham Law advice when leaving a job, the most useful time is before ending employment, accepting the director role or fixing the company structure. If the change has already taken place, an early review can identify issues requiring attention and any applicable obligations.
Pérez Parras Economists & Lawyers can review your Beckham Law file, the timing of the transition, company documents, your duties and your spouse’s position. We then define the scope of the advice and a service proposal suited to your circumstances.
